FIRST KLASS SHIPPING SPECIALIST LIMITED TERMS AND CONDITIONS OF SERVICE

 

Terms and conditions printed on the company's transaction receipt/bill and customer packaging list declaration. By signing this form, we the undersigned accept and abide by the service terms and conditions of First Klass Shipping Specialist Limited.

1.FIRST KLASS SHIPPING SPECIALIST LIMITED does not accept dangerous goods (including weapons, any banned goods, explosives and ammunition, counterfeit goods, animals, bullion, currency, gem stones, human remains; illegal items such as ivory and narcotics. Including any hazardous materials for international carriage without a prior written consent.

2.Subject to the conditions herein, FIRST KLASS SHIPPING SPECIALIST LIMITED shall be liable for the goods during the period they are in its charge or the charge of its agents only if full payment of shipping cost is made latest within five working days after pick up date.

3.The shipper shall comply with all applicable laws and government regulations of any country to, from, through over which the goods may be carried, including those relating to the packing, carriage or delivery of goods, and shall furnish such information and attach such documents to the shipment as may be necessary to comply with such laws and regulations. FIRST KLASS SHIPPING SPECIALIST LIMITED is not liable to the shipper for loss or expense due to the shipper’s failure to comply with the provision.

4.FIRST KLASS SHIPPING SPECIALIST LIMITED as a door to door service shall notify sender of consignment, or the person indicated on the face thereof as the person to be notified prior to delivery. If the recipient declines to accept the goods or cannot be reached; or where a customer request shipment to be returned; FKSS shall use reasonable efforts to return the shipment to sender at sender’s cost, failing which the shipment may be released, disposed of sold without incurring any liability whatsoever to FKSS or anyone else, with the proceeds applied against shipment charges and related admin cost with the balance of the proceeds to be returned to the sender. FKSS shall have the right to destroy any shipment not claimed by customer after 7days of arrival.

5.Should the recipient decline to accept the goods or cannot be reached; or where a customer requests shipment to the returned; FIRST KLASS SHIPPING SPECIALIST LIMITED shall use the most reasonable means to return the shipment to sender at sender’s cost fully. Failing which the shipment may be released, disposed or sold without recourse or liability to FIRST KLASS SHIPPING SPECIALIST LIMITED. Additional storage charges may be applied on any shipment not claimed or refused by recipient after 7days of arrival.

6.FIRST KLASS SHIPPING SPECIALIST LIMITED reserves the right to destroy shipment not claimed by customer after 7—14 days of discharging in its warehouse.

7.On the receipt of consignment, it is the responsibility of the consignee to check the content before signing, after signing for delivery; FIRST KLASS SHIPPING SPECIALIST LIMITED will not be liable for the consignment if no complaint is raised before our dispatchers leave the premises.

 

PACKAGING AND LABELLING

 8.It is the responsibility of the customer to ensure that proper packaging is used and that the contents of the shipment are adequately and securely packed,wrapped and cushioned for transportation. If a shipment is determined to inadequately or improperly packaged, then FIRST KLASS SHIPPING SPECIALIST LIMITED may but is not obliged to, re-package the shipment subject to an additional handling charge.

It is the responsibility of the customer to accurately provide the name, address and contact details of the recipient.

FIRST KLASS SHIPPING SPECIALIST LIMITED shall not be liable for damages caused to a consignment owning to improper packaging or damages caused as a result of mixing liquids including bleach, detergents, soap, oils, fresh milk etc. with food items. FKSS shall not also be liable for damage to perishable goods.

 

LIABILITY

1.FIRST KLASS SHIPPING SPECIALIST LIMITED shall be liable in respect of any shipment transported by sea; if negligence and fault is identified to be on the part of FKSS. Compensation will be subject to the provision of evidence of purchase by the sender which must be between two months of shipment. No refund can be made where there’s no evidence of purchase or receipt. Any compensation offered in the absence of proof of purchase will be done at the discretion of FIRST KLASS SHIPPING SPECIALIST LIMITED.

COMPLAINTS & CLAIM PROCEDURE

FIRST KLASS SHIPPING SPECIALIST LIMITE shall accept complaint made in writing by the person entitled to delivery or sender of the said goods only; under such conditions:

There must be visible damage to baggage, parcel document immediately after discovery of the damage and at the latest within 7 days from receipt of goods. The person entitled to delivery or sender must make a complaint to FKSS in writing in case:

Customers are advised to keep their receipts and invoice at all times as this may be required upon request by FKSS.

i.Complaint should be made within 7 days from receipt of goods, after which date no complaint will be accepted

ii.Of other damage to goods, within 7 days from the date of receipt.

iii.Of delay, within 14 days of the date the goods are placed at his disposal and

iv.of non-delivery of the goods, within 6 weeks from the date of the issue of the invoice

v.any rights to damages against FKSS shall be extinguished unless an action is brought within 3 months from the date of arrival at the destination

Any rights to damages against FKSS Ltd shall be extinguished unless an action is brought within 7 days from the date of arrival at the destination.

FIRST KLASS SHIPPING SPECIALIST LIMITED shall respond to all queries reported within 21 working days after investigations have been made.

 

CLAIMS PROCEDURE

Claims shall be made by complying to the below procedure, FKSS reserves the right to reject claims made without following due process:

you must follow the claims procedures below:

i.within 7 days of receiving goods, the sender shall inform FKSS in writing should there be any concerns with the delivery

ii.The sender shall attach a copy of the delivery note specifying notification made to the FKSS representative who delivered the goods.

iii.The request for claim for damage must be accompanied by a list of shipment which was originally declared to FKSS, in the original packaging. This must be made available to the Manager in the Ghana office for inspection at the time of making the complaint.

Goods received signed for on the delivery sheet shall be deemed as delivered in good condition unless the recipient has noted any damage on the FIRST KLASS SHIPPING SPECIALIST LIMITE delivery sheet.
